Terms and Conditions for Flavour Subscription
General Terms and Conditions for the SodaStream Flavour Subscription Effective Date: December 15, 2025
1. Subscription Terms and other relevant documents
1.1. These terms and conditions for the SodaStream Flavour Subscription (“Subscription Terms”), together with the Legal Terms and Shipping Info, including our Privacy Policy (all found here) govern the sale of goods via SodaStream's online flavour subscription service by SodaStream Australia Pty Ltd (ACN 104 202 093) (“SodaStream”, "we", "us" and "our") to "you" via SodaStream Australia's website at www.sodastream.com.au (“Website”).
1.2. Please read these Subscription Terms carefully before placing a subscription order on the Website.
1.3. By placing a subscription order on the Website, you agree to these Subscription Terms and the other conditions and terms mentioned in clause
1.1 (collectively, the “Conditions”). The Conditions apply to all subscription orders with us. 1.4. In case of any conflict with the other documents mentioned in clause
1.1, these Subscription Terms take precedence.
2. Contact Information
2.1. If you need to contact SodaStream in respect of a subscription order, our contact details can be found here.
2.2. The same contact details apply if you wish to file a complaint or contact us for any other reason.
2.3. If we need to contact you, we will do so in writing via the email address you provided when placing your order.
3. Subscription
3.1. The subscription service is intended for SodaStream customers who wish to regularly order selected SodaStream flavours.
3.2. When making a subscription order on the Website, you will be required to select: a) which products you wish to receive on a recurring basis as part of the subscription ("Subscription Products"); b) the address you wish to have the Subscription Products delivered to ("Delivery Address"); c) the payment method that you wish to use to pay for the Subscription Products ("Payment Method"); and d) the frequency or delivery interval of the flavour subscription ("Delivery Frequency"). 3.3. It is your responsibility to ensure the accuracy of information entered into our Website by you and SodaStream will not be liable for any errors made by you when entering the information listed in clause 3.2 onto the Website whilst making a subscription order.
3.4. The subscription starts on the day the first flavour subscription order is placed on the Website ("Commencement Date"). Subject to these Subscription Terms, the Subscription Products will continue to be delivered to the Delivery Address at the Delivery Frequency (each individual instance a "Subscription Delivery") and charged to the Payment Method from the Commencement Date until the subscription is terminated in accordance with these Subscription Terms by you or us.
3.5. The Delivery Address cannot be a PO Box.
3.6. You may also benefit from promotional offers available at the time of subscription or offered to members from time to time. In order to benefit from any such promotional offers, you must comply with the instructions for use that are published in respect of each individual promotional offer from time to time.
4. Eligible Products
4.1. Only selected products sold by SodaStream on www.sodastream.com.au are eligible for the flavour subscription. These are listed on the product page for configuring the subscription. The selection may change from time to time. We will notify you via email if your Subscription Product is removed from the list of products which are eligible for a subscription, whereupon you may choose to cancel or amend your subscription.
4.2. The delivery of the Subscription Products is subject to stock availability. If any of your Subscription Products are not available for a particular Subscription Delivery we will email you whereupon you may cancel that Subscription Delivery or you may amend the Subscription Products for that Subscription Delivery (in which case you will be charged the advertised price for the amended Subscription Products for that Subscription Delivery).
5. Eligibility
5.1. You may only purchase products on our website if you are over 18 years old or have parental/guardian consent if you are under 18. By placing an order, you confirm that you meet these requirements.
6. Ordering Process and amending subscriptions
6.1. In order to sign up for a subscription you must have created an account on our Website that is linked to a particular email address ("User Account").
6.2. Subscription orders can only be placed via the Website.
6.3. Once you have successfully created a subscription and paid for your first Subscription Delivery you will receive an order confirmation email, and later a shipping notification (also by email) when each Subscription Delivery is dispatched.
6.4. We will also send you an email notification 5 days before each individual Subscription Delivery.
6.5. You can manage your subscription to make changes to the Subscription Products, Delivery Address, Payment Method or Delivery frequency by logging into your User Account. Any changes you make to your subscription more than 24 hours before the next Subscription Delivery (the "Lock-In Date") will apply to the next Subscription Delivery.
6.6. You may choose to skip a particular Subscription Delivery. This means that you will not receive or pay for that particular Subscription Delivery, but your subscription will otherwise continue, and your next Subscription Delivery will occur as usual. If you would like to skip a Subscription Delivery you can do so on your User Account, however this must be notified to us prior to the Lock-In Date for that Subscription Delivery.
7. Costs and Payment
7.1. Prices include GST and any applicable subscription discounts.
7.2. Payment is automatically processed from the Payment Method on the day your order is dispatched being the day you receive the email dispatch notification referred to in clause 6.3 ("Payment Date").
7.3. Accepted payment methods include Klarna, Visa, MasterCard, American Express, Apple Pay, Shop Pay.
7.4. If we attempt to deduct the price from your chosen Payment Method on the Payment Date and the payment fails and is not resolved within 90 days, SodaStream may cancel your subscription and only Subscription Deliveries which have been fully paid for will be delivered.
8. Delivery Conditions
8.1. Delivery costs are shown on the website when placing your subscription order. If we make any changes to the delivery costs we will provide you with at least 30 days' written notice. The new delivery costs will only apply to Subscription Deliveries that occur after the end of the notice period.
8.2. There will be no delivery costs for subscriptions that involve 10 or more flavours being delivered in each Subscription Delivery.
8.3. SodaStream utilises third-party delivery providers to ship Subscription Deliveries and as such, estimated delivery times cannot be guaranteed. If your delivery has not arrived when expected please contact our customer service team in accordance with clause 2.1. If a particular Subscription Delivery is more than two weeks late, and you give us written notice of this, you will receive a 50% discount on the price for that Subscription Delivery. If a particular Subscription Delivery is more than a month late and you give us written notice of this, you will receive a full refund on the price for that Subscription Delivery.
9. Termination of Subscription
9.1. You can cancel your subscription at any time via your User Account or by calling 1300 763 278. If you cancel your subscription after the Lock-In Date for a Subscription Delivery, you will still receive and be charged for that Subscription Delivery, however you will not receive or be charged for any subsequent Subscription Deliveries.
9.2. SodaStream may cancel your subscription:
a) in accordance with clause 7.4 due to payment failure; b) if your address cannot be verified; c) if SodaStream reasonably suspects there has been any fraud; or d) where you breach these Conditions. 9.3. Where a subscription is terminated for any reason, all Subscription Deliveries which have been fully paid for up to the point of termination will be delivered.
10. Changes to Terms of Sale 10.1. We reserve the right to make changes to our Website, policies, and these Subscription Terms at any time. 10.2. Where we make changes to these Subscription Terms we will provide you with 30 days' written notice. The amended Subscription Terms will only apply to Subscription Deliveries that occur after the end of the notice period. 11. Data and Privacy
11.1. In order to fulfill your Subscription Order, we will process your data in accordance with SodaStream's privacy policy (as referred to in clause 1.1) and all applicable local data protection laws.
12. General
12.1. No failure or delay by you or us to enforce any right under the Conditions will constitute a future waiver of that right.
12.2. If any term or provision of the Conditions is found to be illegal, invalid or unenforceable it is severed from the Conditions and the remaining terms or provisions of the Conditions continue unaffected.
12.3. These Subscription Terms are governed by the laws in force in Victoria, Australia. You and us unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and their courts of appeal.
12.4. No term or provision of the Conditions is to be construed adversely to SodaStream solely on the ground that SodaStream was responsible for the preparation of the Conditions.
